KAIKHUSHRU IRANI AND 8 OTHERS FILE MISC. PETITION IN HIGH COURT TO SET ASIDE THE 29TH MAY 2022 ELECTIONS AND HOLD FRESH ELECTIONS
Under cover of letter dated 25th July 2022, Advocate Viraj Bansod has served a Misc. Petition No. 23225 of 2022 filed by Kaikhushru Irani and 8 others against BPP and 26 other Respondents for hearing fixed on 2nd August 2022 pertaining to cancel the May elections and conduct fresh elections and other prayers made therein.
However the Judge in Charge has developed Covid and hence hearing is not going to be held early.
The 26 Respondents are the 14 candidates (excluding Kaikhushru Irani who came last among 15 candidates and lost his deposit too), 10 Election Commissioners and 2 EVM operators. The 9 Petitioners are all lackeys of Kersi Randeria, under whose instruction this Petition has been filed as admitted by one of the Petitioner himself. The community will have to pay legal costs of crores if the matter is allowed to be argued aside from another Rs. 50 lakhs as cost of holding another election.

OUR COMMENTS: It seems that Kersi Randeria and his motely crowd/supporters are Poor losers. Kaikhusru Irani on behalf of Kersi Randeria along with his usual cry babies of Shahrukh Billimoria, Arzan Ghadially, Noshir Dadrawala, Vispi Irani, Yasmin Mistry and 3 others have filed Petition for Re-election. Though the Minority Trustees opposed EVMs before Justice Kathawalla, the Majority insisted on it and now Irani comes last securing just about 400 votes and even losing his Deposit and Randeria comes 11th with his own panel members securing more votes and now they find fault with EVMs.
None of the other fourteen candidates have filed any objection or support this Petition. Of course they will chip in when instructed by Randeria. One of the so called Petitioner when confronted about signing the Petition blurted out that he did not want to but he was forced to sign due to persistent pleading and request by Kersi Randeria personally and he could not say no to him.
They are aware that nothing is going to happen but this is only to save face when Randeria stands again after 5 years to show how he was made to lose in 2022 due to EVM fixing. Who will pay legal costs of the 10 Election Commissioner’s appointed by High Court. Next time who will offer free service as ECs if they are going to be hounded by poor losers. This litigation if allowed by HC will cost a few crores. Kersi Randeria, Noshir Dadrawala and Kaikhushru Irani make enough funds but the 10 EC s and 15 candidates (of whom 7 will be paid by BPP) have to bear legal costs of crores. If re-election ordered another 50 lakhs cost of holding election will have to be incurred.
BPP has no money to pay staff salary and here what a wastage to sooth the ego of the losers. Their allegation is malfunctioning of a few EVMs and hence Re-election.
No appeal lies against EC orders, appointed by the Division Bench of the High Court. Kersi Randeria, Noshir Dadrawala and Kaikhushru Irani should be levied exemplary costs to prevent such abuse of court proceedings. In fact even before the matter is taken up by the High Court, all the 9 Petitioners should be asked to Deposit Rs. 5 lakhs each to show their bonafides.
Not just this but we are informed by Jt CP’s office that Kersi Randeria, Kaikhushru Irani and Shahrukh Billimoria have been pressuring the police to file a Charge sheet against Viraf Mehta as a co-conspirator with Dinshaw Mehta in the Musharraf Kader case though EOW and MRA Marg have already given reports exonerating Dinshaw Mehta of any misappropriation.
And the pending Charge sheet is only for using Musharraf’s 25 lakhs from 31-3- 2013 to November 2013 for which he was rewarded with Tenancy by Kersi Randeria.
