5 FACTS THE COMMUNITY SHOULD KNOW
FACT 1
The prevalent SOPs do not permit the holding of elections.
This has been confirmed by the BMC as on October 22, 2021 who have categorically stated that the prevalent SOPs of 2nd August 2021 are applicable in relation to holding of elections and electioneering, which do not permit elections or electioneering, meetings, rallies, etc. The community has been lied to by Noshir Dadrewala and Kersi Randeria who insisted that elections be held irrespective of the SOPs. In fact, the Courts would not permit holding of elections and hence knowing this, they indulged in blackmail to surrender to their illegal demands instead of moving the Courts as per Consent Terms signed by all seven Trustes.
FACT 2
The fast was nothing but blackmail
Noshir Dadrawala and Kersi Randeria have been in minority since the resignation of Yazdi Desai. The High Court has not entertained their application to hold elections until the SOPs allowed. Having hatred of being in the minority, the two Trustees decided to go on a fast, blackmailing the community to ensure their demands are met
FACT 3
Viraf Mehta requested that the Scheme of Elections be amended
It is undisputed that Viraf Mehta was insistent during all negotiations that the Scheme of Elections be amended before the announcement of date of elections. This found favour with Xerses Dastur and Armaity Tirandaz. However, Noshir Dadrawala would not break his fast unless elections were announced regardless of the amendment of the Scheme.
Fact 4
Kersi Randeria proposed the appointment of an ADMINSTRATOR
At the meeting between the lawyers for the parties, Kersi Randeria stated that if the elections are not held in March 2022, he would move for an Administrator to be appointed to take over the BPP. This was opposed by Viraf Mehta and Berjis Desai.
Fact 5
Trustees forced to give up their term
In this entire farce of a fast, the Trustees were forced to give up their term only to ensure no untoward incident happen to Noshir’s health. Noshir did not care for the amendment of the Scheme but was adamant that all trustees resign in March or else he would continue his fast. This is a clear case of holding the community to ransom. All of this just because two Trustees were not happy to be in a minority.
